Introduction

These terms and conditions (the "Terms") apply to the purchase and installation of ceramic coating products (the "Products") offered by Emotive Auto Detailing (the "Company").By purchasing, the customer ("You" or "Your") agrees to be bound by these Terms. If you do not agree to these Terms, you should not purchase the Products.

Scope of Services

The Company agrees to provide the following services in connection with the installation of the Products: Surface preparation, Installation of the Products according to our defined standards below, Final inspection and quality control.

Standards

To ensure the Company provides a consistent and long-lasting install, all paint ceramic coating installations will prioritise longevity over invisibility. The Company will always strive to provide the best service possible and take great care in performing the ceramic coating for your vehicle. However, it is important to note that no job is ever 100% "perfect". There will likely be slight imperfections in the final result that do not affect the overall performance of the coating. The Company will not be held liable for any such imperfections. The Company stands behind the quality of its work and will always do its best to address any concerns You may have.

Guarantee

The Company’s ‘Showroom Shine’ guarantee guarantees your vehicle to be in showroom condition for 9 years. “Showroom condition” is defined by the Product manufacturers outlined below respective to the Product(s) you are having installed on your vehicle per your estimate. Not all of the products we offer have a guarantee. This guarantee is subject to any mention or lack thereof of a guarantee in your estimate.

Pre-Existing Defects

The Customer acknowledges that their vehicle may have pre-existing defects, such as scratches, dents, or other imperfections. The Company will not be held liable for any pre-existing defects. The Customer is responsible for evaluating the condition of their vehicle before any Product(s) are installed. The Customer understands that the ceramic coating and paint protection film are not repair services and are intended to provide a protective layer over the existing condition of the vehicle's paint.

Payment

You agree to pay the total amount listed in the written estimate upon completion of the work. The Company reserves the right to retain possession of Your vehicle until full payment is received.

Warranties

The Product manufacturer(s) will provide the warranty or guarantee for the product and your vehicle. These warranties and guarantees are outlined below. You agree to the terms of the warranty or guarantee that applies to the Product(s) being installed. The Customer agrees to register for the Product warranty and/or guarantee within the required time.

Indemnification

You agree to indemnify and hold the Company and the Company’s employees harmless from any and all claims, damages, or expenses arising out of the services provided.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Victoria.

Entire Agreement

These terms and conditions constitute the entire agreement between You and the Company and supersede all prior understandings or agreements, whether written or oral.

Fireball Ceramic Coating Guarantee (coating manufacturer)

In the unlikely event that there is noticeable staining or fading of your vehicle’s painted gloss finish caused by exposure to UV rays, fallout, road salt, acid rain, tree sap, bird droppings, lotions and cosmetics, Emotive Auto Detailing will repair the damage and re-apply the coating free of charge.

To ensure the guarantee is valid you must register the guarantee within 30 days of application. The guarantee should only cover M1 classification passenger vehicles up to 8 seats Excludes commercial vehicles. Application must have been carried out by a Fireball Accredited Detailer. The guarantee is non-transferrable and covers nine years from the date of application. This guarantee applies to OEM paint finishes only. Emotive Auto Detailing reserves the right to inspect and re-treat the vehicle, using their choice of Fireball Accredited installer or other authorised third party. This should be at a mutually convenient time and location where possible. Exclusions: Inadequate or poor preparation of the surfaces prior to the application of the Fireball system. Inadequate or poor application of the coatings. Specific damage caused by non-Fireball products. Fire, accident and collision damage, malicious damage, stone chips, extreme weather conditions (hailstones etc)Scratching, swirl marks and hazing caused by (but not limited to) handheld wash brushes, equipment, automated car washes, hand car washes or contaminated cloths, sponges, mitts and chamois leathers/drying towels. Damage to surfaces through, solvent attack, fire, industrial oil, inks, permanent markers, glue, paint, corrosive substances, dyes or bio-hazardous materials. Torn, ripped, scratched or scraped leather and fabric surfaces. General deterioration through wear and tear. Manufacturer paint and surface defects, including but not limited to; orange peel, foreign matter, peeling, and delamination)Matt or satin paint finishes. Cabriolet fabric roofs. This warranty does not cover damage caused by accidents, abuse, neglect, or normal wear and tear. If the Products fail to meet the terms of this warranty, the Company will, at its discretion, repair or replace the products at no cost to you. This warranty is non-transferable and only applies to the original purchaser of the Products. If you previously made a claim under this guarantee on two occasions. The damage takes place in a country which was not the place of purchase or where we do not distribute the coating at the time of purchase by you.

Aftermarket Or Repainted Vehicles

The Products are designed to be installed on fully cured new & original paint. Aftermarket or repainted panels have a chance of the paint peeling during installation or upon removal in the future due to the chance of improper preparation work done. Due to the unknown history of paintwork, even on new vehicles, we are unable to verify the readiness or qualification of Your vehicle’s paint. You acknowledge the risk and agree that the Company would not be liable in the event that damage did occur.
